Family of Elderly Man Sues Avamere over Injuries
Published on Fri, 03/18/2011
Recently, we filed a lawsuit against Avamere (a residential care provider) on behalf of some courageous clients who are outraged by the mistreatment of their father. The suit alleges that Gerald Matlock, 74, fell at least 27 times over a five month period at the Avamere Newberg care facility.
The complaint alleges that, as a result of Avamere’s negligence, Matlock suffered numerous facial lacerations and a broken nose during his 27th fall at Avamere Care Facility-Newberg, a fall that sent him to the hospital and resulted in the loss of six pints of blood. The suit further alleges that Avamere fraudulently represented itself to be a certified Alzheimer's/dementia unit with sufficient resources and experience to offer professional care for patients like Matlock. Adult Protective Services investigated Avamere and concluded that the care facility "failed to provide appropriate care" to Matlock.
This is the second lawsuit we have filed against Avamere in the past three months. Unfortunately, we believe that this is the “tip of the iceberg.” We believe the investigation will reveal that numerous individuals at various Avamere (and other) facilities in Oregon have suffered neglect, mistreatment or abuse.
