O’Donnell Clark & Crew Files Supreme Court Brief on Casino Case

For the last several years, O’Donnell Clark & Crew LLP have been fighting on behalf of PACT–a group of citizens of the town of Florence–to rid the town of the Three Rivers Casino, arguing that the Governor does not have the constitutional authority to site a casino, even on tribal lands, given the Oregon Constitution’s prohibition on casinos.
In 2008, we won a victory at the Oregon Court of Appeals, which ruled that, after five years of procedural obstacles put up by the government and the tribes, the case should be sent to the trial court for decision on the merits. Now the government has appealed. Here is the Supreme Court Brief we filed on January 6, 2009. We expect argument in the Spring of 2009, and a decision shortly thereafter. With any luck, we will be back at the trial court level later this year, with a decision on the merits that holds the Governor accountable to the Oregon Constitution.
